Rule issued for biofuel payment program

USDA Rural Development has issued an interim rule for the Advanced Biofuel Payment Program—to support and ensure an expanding production of advanced biofuels by providing payments to eligible advanced biofuel producers.

Eligible applicants are entities that produce and sell eligible advanced biofuel.

Advanced biofuels are typically fuels produced from renewable biomass other than corn kernel starch.
Under the program, USDA Rural Development enters into contracts with advanced biofuel producers to pay them for the production of eligible advanced biofuels.

Producers must first enroll in the program by the established deadlines. The agency will then make an eligibility determination, and issue eligible producers a contract for execution.

Once executed by the producers and the agency, the producers will be required to submit payment applications to the agency each quarter.

Quarterly payments will be made on eligible advanced biofuel produced during that quarter. One-time additional incentive payments may be made to certain producers who increase advanced biofuel production over the previous year’s production.

The enrollment window for Fiscal Year 2010 funding consideration is between: March 14 and April 12.
